General Code of Conduct

Henry Schein One UK Limited (referred to herein as “our,” “us”, “we,” or “Dentally”) is providing this community subject to these terms and conditions. Our community is there for everyone, however we want to make sure that the community offers a positive experience for all visitors. Therefore, we have established these Terms and Conditions (“Terms”). These Terms govern your use of the Dentally community (“Community”) and the associated features. By using the Community, you agree to be bound by these Terms. If you don’t agree to be bound by these Terms, do not use the Community. Additional terms may apply with respect to your use and access of Dentally products and services other than the Community as specified in an applicable written or electronic agreement between the parties thereto (“Other agreement"). In the event of any conflict or inconsistency between these Terms and any Other Agreement, these Terms will control with respect to the Community.

Eligible Users

You may use the Community only if you are 18 years or older and capable of forming a binding contract with Dentally, and not otherwise barred from using the Community under applicable law.

Be Friendly

Users must treat one another with respect. Users will not post any racist, insulting, sexist, discriminatory, threatening or otherwise insulting comments, will not use coarse language, make inappropriate jokes or otherwise harass other users.

Stay on Topic

Please do not change the subject of a discussion to something not intended by the original poster. Any off-topic posting or “hijacking” of threads will result in content being removed and ultimately can cause users to be denied access to the community.

No Commercial Use

Users may not use the forum for (commercial) activities such as the advertising or sale of products or services, the sending of commercial messages (spam), the offering of (interactive) games or the advertising of other chat forums or websites.

No Sharing of Private Information

Please refrain from sharing personal information (telephone numbers, email addresses, etc.) of yourself, other people or companies.

No Multiple Accounts

It is not allowed to own multiple accounts on this community. If the Community team detects double accounts all secondary accounts will be banned.

Moderator Actions

The Community Team reserves the right to change or remove content or to restrict access to individual users, should it be regarded as necessary. It is not allowed to discuss any Moderation actions in public, should you disagree with an action taken then please contact a Moderator or the Community Manager via private message.

Be Careful

All users on this community are here to help, however nobody can be held responsible for any negative consequences resulting out of information derived from this community.

Prohibited Content

Your use of the Community must comply with these policies:

Irrelevant Content

Topics and posts must be clear, concise, and related to support for the specific category that is the focus of that forum.

Spam

Don’t spam the forums or create topics or posts with spammy content, including content or URLs that are promotional or commercial in nature, repetitive, unrelated, or excessive.

Nudity and Sexually Explicit Material

We don't allow nudity, sexually explicit material, or content that directs traffic to pornography sites.

Harassment or Violent Behaviour

We don't allow behaviour that harasses, threatens, or bullies forum participants or anyone else. Harassment can take many forms including stalking, repetitive pestering of a targeted individual, profanity, and unwanted sexualization. Additionally, do not allow depictions of graphic or gratuitous violence.

Hate Speech

We don't allow the promotion of hatred toward groups of people based on their race, ethnic origin or nationality, religion, disability, gender, age, veteran status, sexual orientation, gender identity, or affiliation with any other protected group.

Impersonation

We don't allow impersonation of other people or companies or other behaviour that is misleading, deceptive, or fraudulent.

Private and Confidential Information

We don't allow unauthorised publishing of people's private and confidential information, including credit card numbers, Social Security numbers, driver's and other license numbers, addresses, or any other information that is not publicly accessible. Do not post or distribute images or videos of minors without the necessary consent from their legal representatives.

Infringement

Do not post, upload, publish, submit or transmit any User Content that: (i) infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is disparaging, defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any person or entity; (vii) promotes illegal or harmful activities or substances.

Copyright

We will respond to clear notices of alleged copyright infringement.

Child Exploitation Content

We don’t allow content that exploits or abuses children. This includes all child sexual abuse imagery (even cartoon images) and all content that presents children in a sexual manner. We will remove such content and take appropriate action, which may include disabling accounts and reporting it to appropriate authorities.

Malicious or Deceptive

Don’t facilitate the distribution of malware, viruses, destructive code, anything that may harm or interfere with the operation of the networks, servers, or other infrastructure of Dentally or others. Don’t facilitate the distribution of any phishing or social engineering content.

Illegal Activities

Keep it legal. Don’t engage in illegal activities, promote dangerous and illegal acts, or depict illegal activity. This includes content that facilitates the promotion or sale of illegal drugs or recruits or fundraises on behalf of violent extremist groups. We also don’t allow the promotion of regulated products or services, including alcohol, gambling, and pharmaceuticals.

User Profile

Your photo, display username, bio, and associated websites and links (if applicable) must comply with these policies. Additionally, we don’t allow photos, display names, taglines, bios, or links that contain profanity, lewdness, racial slurs, malicious content or gibberish.

For certain features of the Community you’ll need an account with Dentally. Dentally reserves the right to change its account registration requirements and procedures from time-to-time, and will have sole discretion in deciding whether or not to approve your account. It’s important that you provide us with accurate, complete and current account information and keep this information up to date. If you don’t, we might have to suspend or terminate your account. To protect your account, keep the account details and password confidential, and notify us right away of any unauthorized use. You’re responsible for all activities that occur under your account.

Prohibited Activities

You agree not to do any of the following:

  • Use, display, mirror or frame the Community or any individual element within the Community, Dentally’s name, any Dentally trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Dentally’s express written consent;
  • Access, tamper with, or use non-public areas of the Community, Dentally’s computer systems, or the technical delivery systems of Dentally’s providers;
  • Attempt to probe, scan or test the vulnerability of any Dentally system or network or breach any security or authentication measures;
  • Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measures implemented by Dentally or any of Dentally’s providers or any other third party (including another user) to protect the Community;
  • Attempt to access or search the Community or download content from the Community using any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by Dentally or other generally available third-party web browsers;
  • Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation in connection with the Community;
  • Use any meta tags or other hidden text or metadata utilizing a Dentally trademark, logo URL or product name without Dentally’s express written consent;
  • Use the Community or any portion thereof, for any commercial purpose or for the benefit of any third party (other than pursuant to an active Other Agreement with Dentally) or in any manner not permitted by these Terms;
  • Accept any gifts, services, money or anything of value from other users or Dentally’s partners for direct or indirect personal gain as a community member in connection with the Community;
  • Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Community;
  • Collect or store any personally identifiable information from the Community from other users of the Community without their express permission;
  • Impersonate or misrepresent your affiliation with any person or entity;
  • Violate any applicable law or regulation;
  • Use the Community to benchmark or to build similar or competitive products or services as offered by Dentally; or
  • Encourage or enable any other person or entity to do any of the foregoing.

Reporting Abuse and Consequences

If you believe that a topic or post violates these policies, click the three dots menu at the bottom right of a post and then click on 'Report to' flag it for review. In response to a report of abuse or as part of our other review processes, we may review content in the forums and take action if it violates these policies, including restricting access to the content or removing the content.

We reserve the right to change these guidelines at any point in our effort to keep the forum helpful, user-friendly, and safe. We may limit or restrict your participation in the community at our discretion.

Liability

The Community serves as a platform for information exchange among dental professionals and users. While we strive to maintain high-quality discussions, we cannot guarantee the accuracy, completeness, or reliability of any information shared within the community. In connection with your use of the Community, you may receive access to content, information, advice, posts and other materials available on or through the Community, including, but not limited to content and posts from other users, training videos, guides, troubleshooting tips, articles and blog posts (collectively, “Community Materials”). You acknowledge and agree that Dentally is not obligated to monitor any Community Materials for quality, accuracy or completeness, and that your use of and reliance upon any Community Materials will be at your sole risk. We strongly advise verifying any information with appropriate professional sources before application in clinical or business settings.

Neither Dentally nor its affiliates or service providers shall be held liable for any damages, losses, or consequences resulting from the use or misuse of information obtained from the community. This includes, but is not limited to, financial losses, professional misconduct, or patient care issues.

Neither Dentally nor its affiliates or service providers will be liable to you for any loss of use, lost or inaccurate data, interruption of business, costs of delay, lost profits, or any indirect, special, incidental, reliance, punitive, exemplary or consequential damages of any kind, even if informed of the possible of damages in advance. Dentally’s and its affiliates’ and service providers’ total aggregate liability to you in connection with these Terms, the Community, and Community Materials will not exceed £100.

Users are encouraged to exercise professional judgment and adhere to best practices and ethical standards when applying information gathered from the community.

Dentally reserves the right to remove any content deemed potentially harmful or misleading, but does not assume responsibility for monitoring or validating any information.

You will defend and indemnify Dentally and its affiliates, and their respective officers, directors, employees, and contractors, from and against any claim by a third party arising from or related to your use of information obtained through the Community, your use of the Community in violation of these Terms, your violation of any law or the rights of any third party, or any submissions by you to the Community including without limitation any claim of infringement, misappropriation, or violation of any intellectual property, privacy, or other rights.

The Community may contain links to third-party websites, resources, or services that are not owned or controlled by Dentally.

Dentally has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Users acknowledge and agree that Dentally shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party websites or services.

The inclusion of any links to third-party websites does not imply endorsement by Dentally. Users access and use these websites or resources at their own risk.

We strongly advise our users to read the terms and conditions and privacy policies of any third-party websites or services that they visit via links from our community.

Dentally reserves the right to remove any links to third-party websites from our community at any time without notice.

The Community, related services, and Community Materials are provided “AS IS” without warranty of any kind. Without limiting the foregoing, we explicitly disclaim any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment and non-infringement, and any warranties arising out of course of dealing or usage of trade. We make no warranty that the Community or any Community Materials will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the availability, quality, accuracy, timeliness, truthfulness, completeness, or reliability of the Community or any Community Materials.

Your Content and License

The Community may allow you to store, transmit, post, or share content such as text (in posts or communication with others), files, documents, graphics, images, audio, video and other materials. Anything (other than Feedback as defined below) that you post or otherwise make available through the Community is referred to as "User Content"). Dentally does not claim any ownership rights in any User Content and nothing in these Terms will be deemed to restrict any rights you may have to your User Content outside of the Community. Any User Content that you post, upload, provide or submit to the Community is generated, owned and controlled solely by you, and not by Dentally. You acknowledge and agree that your User Content remains your sole responsibility.

By uploading or posting your User Content on or via the Dentally Community, you acknowledge that your User Content will be exposed to the public.

By using the Community, you grant Dentally (and its affiliated companies or service providers) a non-exclusive, perpetual, worldwide, royalty-free, irrevocable, sub-licensable through one or more tiers, and transferable right and license to use, modify, adapt, reproduce, translate, create derivative works, copy, distribute, transmit, publicly display, publicly perform, edit, translate and reformat your User Content in connection with operating, improving and providing our products and services. No compensation will be paid with respect to the use of your User Content, and Dentally has no obligation to post or use any User Content you may provide.

You agree that your Community account and any content you post may not be automatically deleted even after your use of the site has ceased, unless this is requested directly. You should know that in certain instances, some of your User Content (such as support requests and logs) may not be completely removed and copies of your User Content may continue to exist on the Community. To the maximum extent permitted by law, we are not responsible or liable for the removal or deletion of (or the failure to remove or delete) any of your User Content.

We appreciate feedback, comments, ideas, proposals and suggestions for improvements to the Community or any of Dentally's other products or services ("Feedback"). If you choose to submit Feedback, you agree that we are free to use it without any restriction or compensation to you, and you warrant that you have the right to provide us with such Feedback without infringement or violation of any third-party rights.

Removing Content and Restricting Access

The Community team reserves the right to remove any content from the community at its discretion, without prior notice, if such content is deemed by Dentally in its sole discretion as inappropriate, harmful, or in violation of these Terms.

Similarly, the Community team has the authority to restrict or revoke access to the Community for any user who violates our terms of service, engages in disruptive behavior, or compromises the integrity of the Community.

Actions taken by the Community team, including content removal and user banning, are carried out to maintain a safe, professional, and valuable environment for all members.

If you believe that content has been unfairly removed or that your access has been unjustly restricted, you may contact our Community team for review at community@dentally.com.

While we will consider all inquiries, please note that decisions regarding content removal and access restrictions are ultimately at the discretion of the Community team.

Availability of the Community

While we strive to maintain consistent access to the Community, we cannot guarantee uninterrupted availability of the platform.

Dentally reserves the right to suspend, modify, or discontinue the community service, either temporarily or permanently, at any time and without prior notice.

Users are strictly prohibited from attempting to disrupt, damage, or interfere with the functionality of the Community. This includes, but is not limited to, hacking attempts, denial-of-service attacks, or the introduction of malware.

Dentally shall not be held responsible for any costs incurred by users in accessing or using the community platform. This includes, but is not limited to, internet service provider fees, data charges, or any other expenses related to accessing our Community.

We will make reasonable efforts to notify users of scheduled maintenance or anticipated disruptions to the service. However, we are not liable for any losses or inconveniences that may result from such interruptions.

By using the Community, users acknowledge and accept that access to the platform may not always be available and that Dentally is not responsible for any consequences resulting from service interruptions or unavailability.

Account Deletion and Termination

At any time you can write to Dentally at community@dentally.com from the email address associated with your account and request that your account be deleted. Dentally is not obligated to automatically delete your Community account. Any activity you post or any information you have on your Community profile is submitted at your own risk, until you request that your Community account is deleted, or until the Community is discontinued.

Changes to these Terms or the Community

We may update the Terms from time to time at our sole discretion. If we do, we'll let you know by posting the updated Terms on the site or may also send other communications. It's important that you review the Terms whenever we update them or you use the Community. If you continue to use the Community after we have posted updated Terms it means that you accept and agree to the changes. If you don't agree to be bound by the changes, you may not use the Community anymore. As the Community evolves over time we may change or discontinue all or any part of the Community, at any time and without notice, at our sole discretion.

General Term

These terms and any action related thereto shall be governed by the laws of England and Wales.

Dentally and its licensors exclusively own all right, title and interest in and to the Community, including all associated intellectual property rights. You acknowledge that the Community is protected by copyright, trademark, and other laws of England and Wales and foreign countries. You agree not to remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Community.

These Terms constitute the complete and exclusive statement of the mutual understanding between Dentally and you regarding the Community and Community Materials, and cancels all previous written and oral agreements, understandings and communications between Dentally and you regarding the Community and Community Materials. If any provision of these Terms is invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, given the fundamental intentions of the parties, and the other provisions of these Terms will remain in full force and effect. You may not assign or transfer these Terms, by operation of law or otherwise, without Dentally's prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and void. Dentally may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

Dentally's failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Dentally. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
